Terms of Service

Last updated: October 31, 2026

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of alanswenson.dev and the purchase or use of web development, website refresh, website repair, maintenance, and consulting services provided by Alan Swenson Web Development ("we", "us", or "our"), operated by Alan Swenson in Minneapolis, Minnesota. By engaging our services or making a payment, you agree to these Terms.

2. Services and Project Scope

We provide professional website development, website redesigns and refreshes, website repairs (including WordPress, Shopify, Concrete CMS, Astro, Next.js, and custom web applications), security updates, performance optimization, and related technical consulting.

Specific deliverables, project milestones, timelines, and fees are defined in a written proposal, statement of work, quote, or invoice agreed upon with the client before work begins. Any work requested outside the agreed scope may require a separate estimate or change order.

3. Payments and Billing

All prices and invoices are stated and billed in US Dollars (USD) unless otherwise specified in writing. Payments are processed securely through Stripe via credit card, debit card, or other supported payment methods on your invoice or checkout link.

Depending on the service type, payment may be required as an upfront deposit before work begins, upon milestone completion, as a fixed one-time fee (such as for website repair services), or upon final delivery as stated on your invoice.

4. Refund, Cancellation, and Dispute Policy

  • Project Cancellation: Either party may cancel a project by providing written notice. If you cancel a project after work has begun, you are responsible for payment covering all hours worked and milestones completed up to the cancellation date.
  • Deposits and Completed Work: Upfront project deposits and payments for completed milestones, delivered code, or hours already worked are non-refundable once work has commenced, as they reserve scheduling capacity and compensate for time invested. If a prepayment exceeds the value of work performed prior to cancellation, any unused balance will be refunded at our discretion or in accordance with your project agreement.
  • Website Repair Services: For fixed-price repair or diagnostic engagements, if we are unable to resolve the specific issue agreed upon in writing, we will work with you to remedy the issue or provide a refund as specified in your service agreement.
  • Billing Questions and Disputes: If you believe there is an error on an invoice or charge, please contact us through our Customer Support page within 14 days of the charge so we can review and resolve the issue promptly before a payment dispute is initiated.

5. Client Responsibilities

Timely completion of services depends on your cooperation, including providing necessary content, credentials, backups, approvals, and feedback. You represent that you own or have permission to use all text, images, logos, code, and materials you supply to us for inclusion in your website or project.

6. Intellectual Property

Upon receipt of full payment for the applicable services, ownership of the final custom work product created specifically for you transfers to you, excluding pre-existing code, open-source libraries, third-party themes or plugins, and general developer tools, which remain subject to their respective licenses. We reserve the right to display completed projects in our portfolio unless agreed otherwise in writing.

7. Warranties and Limitation of Liability

We perform all services in a professional and workmanlike manner. However, because websites rely on third-party hosting providers, plugins, browsers, and external networks outside our control, we cannot guarantee uninterrupted, error-free operation or immune security after handoff.

To the fullest extent permitted by law, Alan Swenson Web Development shall not be liable for any indirect, incidental, consequential, or lost-profit damages arising out of or related to our services. Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to conflict of law principles.

9. Contact Information

Questions about these Terms, billing, or active projects can be submitted anytime via our Customer Support page, or reviewed alongside our Privacy Policy.
